The purpose of this study was to investigate the relationships between the students’ self-efficacy, test anxiety and performance on Mathematics of Saint Joseph College, Junior High School Department for SY 2019- 2020. The respondents of the study were randomly chosen junior high school students. Descriptive correlational method of research was used. The data gathered were statistically treated using the Excel and IBM SPSS programs, which summarize the percentage scores, weighted means, correlation coefficients, independent t-test values, and corresponding p-values of relevant (...) statistical tools. Findings indicated that, at average, the students were not confident on their mathematical self-efficacy, moderately anxious on their mathematical test anxiety and satisfactory on their mathematical performance. More findings showed that the following variables have significant relationships: mathematical anxiety and mathematical self–efficacy; mathematical self-efficacy and mathematical performance; and mathematical test anxiety and mathematical performance. The higher the self-efficacy level, the lower the degree of testanxiety; the higher the self-efficacy, the better the mathematics performance; and the lower the test-anxiety, the better the performance. The study recommends regular conduct of diagnostic tests on mathematical self-efficacy and test anxiety and design programs to address the enhancement of learners’ mathematical self-efficacy and reduce their mathematical test anxiety. The researcher recommends Mathematics Learning Development Program (MLDP) as the output of the study. (shrink)

A tragédia de Orestes, escrita pelo tragediógrafo grego Ésquilo, influenciou decisivamente o pensamento ético-político de Hegel. Em seu ensaio sobre o Direito Natural (1802-1803), o filósofo alemão associa seu conceito de absoluto com sua interpretação da tragédia grega, ato com o qual expõe sua concepção da vida ética absoluta, dando continuidade à ideia que havia esboçado, no âmbito teológico, em "O Espírito do cristianismo e seu destino", i.e., a de que o destino e a justiça trágica forneceriam os termos de (...) uma alternativa aos conceitos jurídicos kantianos e cristãos de justiça. Mas, em "Sobre as maneiras de tratar cientificamente o direito natural", Hegel vai além. Ele demonstra que o gênero trágico apresenta uma concepção de ética e política que pode ser uma alternativa às concepções modernas do direito natural, o que permite a Hegel opor a representação trágica da unidade da vida ética absoluta ao dualismo e às dicotomias que estruturam as teorias políticas de seu tempo. Essa intuição da tragédia propiciou ao filósofo compreender a vida ética absoluta como o verdadeiro fundamento da ética e da política. Enquanto tal, ela pressupõe, necessariamente, todas as teorias do Direito Natural. Hegel denomina essa representação da unidade da vida ético-política como "a representação da tragédia da vida ética". A obra emblemática e talvez até mesmo inspiradora dessa compreensão do direito natural é "Eumênides", de Ésquilo, peça que encerra a trilogia "Oresteia". A partir dela, Hegel desenvolve, no capítulo intitulado “a ciência especulativa e o direito natural”, sua concepção trágica da vida ética absoluta. É que a tragédia de Orestes expõe o problema político que Hegel quer resolver: as relações entre o universal e o particular, o todo e as partes, o Estado e o indivíduo, etc. Além de explicitar o problema político, a obra de Ésquilo também expõe a solução do que Hegel considera ser o conflito absoluto, i.e., o jogo das oposições (universal/particular, todo/partes, Estado/indivíduos) que consiste na essência da vida ética e política. Tal solução se dá, na peça, com o julgamento do herói, Orestes, e a consequente pacificação das Erínias, transformadas em Eumênides. Esse movimento é a culminação da trilogia "Oresteia" e ilustra o tipo de reconciliação que Hegel procurava produzir com sua Filosofia do Direito: a (re)organização da totalidade ética. (shrink)

E-mails: [email protected] e [email protected] WhatsApp: (82)9.8143-8399. -/- PREMISSA -/- Como na França de Émile Durkheim, os primeiros passos da Sociologia no Brasil, em termos institucionais, ocorreram a partir de iniciativas para a inclusão dessa disciplina no ensino secundário (hoje, ensino médio). A primeira tentativa ocorreu (...) em 1890, logo após a proclamação da República, com a reforma educacional de Benjamin Constant, que defendia o ensino laico em todos os níveis. O ensino secundário tinha por objetivo a formação intelectual dos jovens fora do contexto religioso, então predominante. Mas, sem nunca ter sido de fato incluída nos currículos escolares, a Sociologia foi expurgada pela Reforma Epitácio Pessoa, em 1901. Somente em 1925 a Sociologia retornou ao currículo do ensino secundário por meio da Reforma de Rocha Vaz, que tinha os mesmos objetivos da de Benjamin Constant. Em decorrência dessa reforma, o Colégio Pedro II, na cidade do Rio de Janeiro, implantou a Sociologia regularmente no seu currículo. Em 1928, a disciplina foi introduzida nas escolas de vários estados brasileiros, notadamente em São Paulo, Rio de Janeiro e Pernambuco. -/- Desde 1925, podem-se destacar alguns intelectuais que contribuíram para o ensino de Sociologia no ensino secundário, lecionando e escrevendo manuais para esse nível: Fernando de Azevedo (1894-1974), Gilberto Freyre (1900-1987), Carneiro Leão (1887-1966) e Delgado de Carvalho (1884-1980), em São Paulo, Rio de Janeiro e Recife. Eles tinham por objetivo preparar intelectualmente os jovens das elites dirigentes, elevando o conhecimento daqueles que chegavam às escolas médias. Esses autores, em sua maioria, foram influenciados pela Sociologia desenvolvida na Europa e nos Estados Unidos. -/- Em 1931, a reforma de Francisco Campos, no governo de Getúlio Vargas, introduziu a Sociologia nos cursos preparatórios ao ensino superior nas faculdades de Direito, Ciências Médicas, Engenharia e Arquitetura, além de mantê-la nos cursos normais (de formação de professores). -/- No final do Estado Novo, em 1942, o governo de Getúlio Vargas, através de seu ministro da Educação, Gustavo Capanema, implantou a Reforma Capanema, que excluiu a Sociologia do ensino secundário brasileiro. Assim, a Sociologia fez parte do currículo do ensino secundário por 18 anos (1925-1942). Ela, contudo, permaneceu como matéria obrigatória do currículo das Escolas Normais, de nível secundário, destinadas à formação de professores do antigo ensino primário (o que corresponderia aos atuais 2º a 5º anos). -/- 1. A SOCIOLOGIA NO ENSINO SUPERIOR: INÍCIO DO SÉCULO XX -/- Nas primeiras décadas do século XX, a Sociologia no ensino superior estava presente de forma embrionária em vários estados brasileiros (Pernambuco, Rio de Janeiro, São Paulo) e principalmente nos cursos de Direito. Desenvolveu-se de forma mais consistente, contudo, nos estados que passavam por um processo de industrialização e urbanização crescente desde o final da década de 1910. -/- Essas transformações da estrutura econômica e social repercutiram nas esferas culturais e educacionais, propiciando um crescente interesse pelos estudos científicos da realidade social da época. -/- Em decorrência disso, foram publicados importantes trabalhos que contribuíram para o desenvolvimento das ciências sociais no Brasil. Uma das preocupações dos pensadores daquele período era a busca do entendimento do Brasil por meio de seus componentes históricos, tendo por base as muitas vertentes europeias e estadunidenses das ciências humanas. -/- Esses pensadores defendiam a ideia de que havia uma ligação entre o passado colonial e a configuração social em que viviam. Para eles, esse condicionamento do passado deveria ser superado para que o país saísse do atraso. As preocupações desses pensadores giravam em torno do futuro do Brasil e das possibilidades de mudança social e das resistências a elas. Entre outros, podem ser citados: Francisco José de Oliveira Vianna (1883 -1951), Caio da Silva Prado Júnior (1907-1990), Sérgio Buarque de Holanda (1902-1982), Gilberto Freyre (1900-1987) e Fernando de Azevedo (1894-1974). -/- Pode-se afirmar que foi entre as décadas de 1920 e 1940 que a Sociologia fincou alicerces no Brasil. Nesse período, procuraram-se definir mais claramente as fronteiras entre a Sociologia e as áreas do conhecimento afins, como a Literatura, a História e a Geografia, e institucionalizou-se o curso de Sociologia e/ou Ciências Sociais em faculdades e universidades. Foram fundadas a Escola Livre de Sociologia e Política (ELSP) em São Paulo, em 1933, e as Universidades de São Paulo (USP) e do Distrito Federal (UDF), esta no Rio de Janeiro, respectivamente em 1934 e 1935, nas quais foram instituídos cursos de Ciências Sociais. -/- Vários professores estrangeiros vieram ao Brasil para trabalhar nessas universidades e contribuíram de modo significativo para o desenvolvimento da Sociologia no Brasil. Entre outros, podem ser citados: Donald Pierson (1900-1995), Alfred Radcliffe-Brown (1881-1955), Claude Lévi -Strauss (1908-2009), Georges Gurvitch (1894-1965), Roger Bastide (1898-1974), Charles Morazé (1913-2003) e Paul-Arbousse Bastide (1901-1985). -/- A revista Sociologia, da Escola Livre de Sociologia e Política, foi um exemplo da produção sociológica da época. Criada em 1939 e publicada até 1981, em São Paulo, constituiu um verdadeiro marco de estudo, pesquisa e divulgação das Ciências Sociais no Brasil. -/- 1.1 De 1940 a 1960: disseminação da Sociologia na universidade -/- A partir do final da Segunda Guerra Mundial até meados da década de 1960, disseminaram-se as Faculdades de Filosofia, Ciências e Letras no Brasil, em universidades ou fora delas, e a Sociologia passou a fazer parte do currículo dos cursos de Ciências Sociais ou a apresentar-se como disciplina obrigatória em outros cursos. -/- Uma nova geração de cientistas sociais passou a ter presença marcante no Brasil. Entre eles, podem ser citados: Florestan Fernandes (1920-1995), Antonio Candido (1918-2017), Maria Isaura Pereira de Queiroz (1918-2018), Juarez Rubens Brandão Lopes (1925-2011), Alberto Guerreiro Ramos (1915-1982), Luiz Aguiar da Costa Pinto (1920-2002) e Hélio Jaguaribe (1923-2018), que influenciaram muitos cientistas sociais em todo o território nacional. -/- Os principais temas de pesquisas, análises e discussões nesse período foram: imigração e colonização, estudos de comunidades, educação, folclore, questão rural e urbana, teoria e método das Ciências Sociais, estratificação e mobilidade sociais e sociologia da arte e da literatura. Cabe um destaque para o tema das relações étnico-raciais envolvendo a questão do negro no Brasil, graças a um projeto de pesquisa financiado pela Unesco. -/- Nesse período, a Sociologia tornou-se disciplina hegemônica no quadro das Ciências Sociais no Brasil, e a primeira a formar uma “escola” ou uma “tradição” em São Paulo, tendo em Florestan Fernandes um dos seus mentores. -/- 1.2 De 1960 a 1980: consolidação da Sociologia no Brasil -/- Mesmo sob a ditadura civil-militar no Brasil, a partir de 1964, a Sociologia começou a se expandir, principalmente nos grandes centros urbanos, e a se relacionar com outros campos das ciências humanas. As discussões sobre o processo de industrialização crescente no país foram o centro das atenções. -/- Um dos temas de discussão era o desenvolvimento, incluindo as teorias da dependência e da modernização. Outros temas de debates e pesquisas da época foram o trabalho industrial e o sindicalismo, a formação da classe trabalhadora, a urbanização crescente e as transformações no campo, os problemas da marginalidade social, a presença do capital estrangeiro e a indústria nacional. A questão educacional também esteve presente, pois de alguma forma os problemas sociais estavam vinculados à precariedade do setor. Foram bastante debatidos, ainda, o autoritarismo, principalmente depois do golpe militar de 1964, e o planejamento, criando-se uma interface com a ciência política. Além disso, destacaram-se, nesse momento, os estudos sobre a América Latina. -/- Em razão desses debates, foram incluídas nas universidades disciplinas como: Sociologia do Desenvolvimento, Sociologia Urbana, Sociologia Rural, Sociologia Industrial e do Trabalho (incluindo a questão sindical), Sociologia do Planejamento, Sociologia da Educação e da Juventude e Sociologia da Arte e Literatura. -/- Muitos foram os estudiosos que, em diferentes áreas do pensamento sociológico, desenvolveram pesquisas nessas décadas. Alguns dos que formaram a segunda geração de sociólogos no Brasil são: Octavio Ianni (1926-2004), Marialice M. Foracchi (1929-1971), Fernando Henrique Cardoso (1931-), Leôncio Martins Rodrigues (1934-), Heleieth Saffioti (1934-2010), Maurício Tragtenberg (1929-1998), Francisco de Oliveira (1933-), Luiz Pereira (1933-1985), Luiz Eduardo W. Wanderley (1935-), José de Souza Martins (1938-), Gabriel Cohn (1938-), Roberto Schwarz (1938-), Elide Rugai Bastos, Luiz Werneck Vianna (1938-) e Simon Schwartzman (1939-). -/- 1.3 Diversificação da Sociologia no Brasil -/- A partir da década de 1980, ampliam-se os cursos de graduação e pós-graduação (mestrado e doutorado) em Ciências Sociais e, em particular, de Sociologia em todo o território nacional, elevando o nível, em número e em qualidade, das pesquisas e do ensino da área. Os estudos sociológicos passaram a ser mais específicos, ocorrendo uma fragmentação dos temas/objetos, como: violência, gênero e sexualidade, corpo e saúde, religião, cotidiano, comunicação e informação, indústria cultural, representações sociais, consumo, cidadania, direitos humanos, questão ambiental, globalização, ciência e tecnologia, urbanização, juventude, família, trabalho, classes e mobilidade social, questões étnico-raciais, Estado e sociedade civil. -/- Novas gerações de sociólogos se formam nas universidades em quase todos os estados da federação, e há centros de ensino e pesquisa na maioria das universidades, disseminando-se assim a formação de sociólogos, sob diversas influências teóricas. A formação em Sociologia, que havia se estabelecido a partir de São Paulo e Rio de Janeiro, na década de 1930, expandiu-se para todo o território nacional em pouco mais de 50 anos. -/- 1.4 O retorno da Sociologia ao ensino médio -/- Oficialmente extinta do currículo do ensino médio em 1942, a Sociologia voltou a marcar presença em um ou outro estado da federação, de modo intermitente, a partir da década de 1980, com os primeiros ensaios de democratização da sociedade brasileira, conforme diz o sociólogo brasileiro Amaury C. Moraes, na esteira de mudanças na legislação educacional realizadas pelo governo ditatorial pós-1964. A Lei n° 7.044/82 flexibilizou o ensino médio (então 2º grau) e profissionalizante, abrindo espaço para a presença da Sociologia, não em caráter obrigatório, mas por escolha das escolas. Nesse sentido, ela começou a ter uma presença crescente nos currículos escolares. -/- Aqui cabe citar as Orientações Curriculares para o ensino médio, (p. 104-105). -/- Há uma interpretação corrente que (...) deve ser bem avaliada criticamente; ela afirma que a presença ou a ausência da Sociologia no currículo está vinculada a contextos democráticos ou autoritários, respectivamente. No entanto, se se observar bem, pelo menos em dois períodos isso não se confirma, ou se teria de rever o caráter do ensino de Sociologia para entender sua presença ou ausência. Entre 1931 e 1942, especialmente após 1937, a Sociologia está presente e é obrigatória no currículo em um período que abrange um governo que começa com esperanças democratizantes e logo se tinge de autoritarismo, assumindo sua vocação ditatorial mais adiante. Em outro momento, em plena democracia, o sentido do veto do Presidente da República (2001) à inclusão da Sociologia como disciplina obrigatória traz uma certa dificuldade para essa hipótese. O que se entende é que nem sempre a Sociologia teve um caráter crítico e transformador, funcionando muitas vezes como um discurso conservador, integrador e até cívico – como aparece nos primeiros manuais da disciplina. Não se pode esquecer que a Sociologia chegou ao Brasil de mãos dadas com o positivismo. No caso recente, deve-se entender que a ausência da disciplina se prende mais a tensões ou escaramuças pedagógico-administrativas que propriamente a algum conteúdo ideológico mais explícito (BRASIL/MEC, 2006). -/- Paralelamente, algumas associações de sociólogos, em diferentes estados brasileiros – mas principalmente em São Paulo –, iniciaram um movimento pela volta da Sociologia ao ensino médio, almejando a ampliação de espaço de trabalho para os formandos dos cursos de Ciências Sociais. Apesar de não haver a obrigatoriedade da disciplina, os cursos de Ciências Sociais continuavam a formar professores de Sociologia. Em alguns estados brasileiros, ao longo dos anos, foram abertos concursos para professores de Sociologia. -/- Com a Constituição de 1988 e a consequente formulação das constituições estaduais, sociólogos em todo o país passaram a reivindicar a presença da Sociologia no ensino médio. Assim, leis estaduais de alguns estados e as constituições estaduais do Rio de Janeiro e de Minas Gerais tornaram a Sociologia obrigatória no ensino médio. -/- A partir do ano 2000, organizações representativas de sociólogos (sindicatos e associações de sociólogos e de cientistas sociais) de várias tendências, assim como pequenos grupos nas universidades do país, começaram a desenvolver um movimento em defesa da obrigatoriedade do ensino da Sociologia no nível médio, considerando que os conteúdos dessa disciplina contribuíam para melhor formação do jovem estudante. -/- O movimento estendeu-se ao início do século XXI, conquistando o apoio de instituições de ensino, associações científicas, intelectuais, sindicatos e associações de categorias profissionais. Finalmente, pela Lei n° 11.684, de 2 de junho de 2008, que alterou a Lei de Diretrizes e Bases da Educação Nacional, a Sociologia retornou oficial e obrigatoriamente ao currículo do ensino médio brasileiro. -/- A título de conclusão, e ainda refletindo sobre a Sociologia e sua contribuição para a formação dos estudantes, é importante destacar o que as Orientações Curriculares para o ensino médio afirmam com muita clareza: -/- A presença da Sociologia no currículo do ensino médio tem provocado muita discussão. Além dessa justificativa que se tornou slogan ou clichê – “formar o cidadão crítico” –, entende-se que haja outras mais objetivas decorrentes da concretude com que a Sociologia pode contribuir para a formação do jovem brasileiro, quer aproximando esse jovem de uma linguagem especial que a Sociologia oferece, quer sistematizando os debates em torno de temas de importância dados pela tradição ou pela contemporaneidade. A Sociologia, como espaço de realização das Ciências Sociais na escola média, pode oferecer ao aluno, além de informações próprias do campo dessas ciências, resultados das pesquisas as mais diversas, que acabam modificando as concepções de mundo, a economia, a sociedade e o outro, isto é, o diferente – de outra cultura, “tribo”, país etc. Traz também modos de pensar (...) ou a reconstrução e desconstrução de modos de pensar. É possível, observando as teorias sociológicas, compreender os elementos da argumentação – lógicos e empíricos – que justificam um modo de ser de uma sociedade, classe, grupo social e mesmo com unidade. Isso em termos sincrônicos ou diacrônicos, de hoje ou de ontem. -/- Um papel central que o pensamento sociológico realiza é a desnaturalização das concepções ou explicações dos fenômenos sociais. Há uma tendência sempre recorrente a se explicarem as relações sociais, as instituições, os modos de vida, as ações humanas, coletivas ou individuais, a estrutura social, a organização política etc. com argumentos naturalizadores. Primeiro, perde -se de vista a historicidade desses fenômenos, isto é, que nem sempre foram assim; segundo, que certas mudanças ou continuidades históricas decorrem de decisões, e essas, de interesses, ou seja, de razões objetivas e humanas, não sendo fruto de tendências naturais (BRASIL/MEC, 2006). -/- REFERENCIAL TEÓRICO -/- BRASIL. Starting from the observation that there is a gap between knowledge of the environmental sciences and practical engagement, for example, in climate change or biodiversity loss, this article explores one possible explanation for this situation—namely, the process of objectification inherent in science. It then proposes to remedy the situation by defending the idea of a ‘first-person ecology’. This term refers to a field of research and practice that looks at the relationship between humans and nature from the point of view (...) of the embodied and situated nature of lived experience. The lived experience of nature at the heart of a first-person ecology is first studied from an epistemic perspective using the concept of recognition, inspired by the Frankfurt School philosopher and sociologist Axel Honneth. It is then approached from a phenomenological perspective, using the emerging field of ecospirituality to describe the characteristics of this experience. (shrink)

In this paper I argue that the debate between the so-called “presentists” – according to whom only the present is real – and the “eternalists”, according to whom past present and future are equally real, has no ontological significance. In particular, once we carefully distinguish between a tensed and a tenseless sense of existence, it is difficult to find a single ontological claim on which the two parties could disagree. Since the choice of using a tense or a tenseless language (...) is dictated by purely pragmatic reasons, we should abstain from bringing to bear pseudo-debates generated by the “tensed” or the “tenseless theories” of time on the question of understanding the philosophical implications of contemporary spacetime theories, or notions like becoming, change and persistence in time. This paper offers a critical assessment of the current state of the debate about the identity and individuality of material objects. Its main aim, in particular, is to show that, in a sense to be carefully specified, the opposition between the Leibnizian ‘reductionist’ tradition, based on discernibility, and the sort of ‘primitivism’ that denies that facts of identity and individuality must be analysable has become outdated. In particular, it is argued that—contrary to a widespread consensus—‘naturalised’ metaphysics supports both the acceptability (...) of non-qualitatively grounded (both ‘contextual’ and intrinsic) identity and a pluralistic approach to individuality and individuation. A case study is offered that focuses on non-relativistic quantum mechanics, in the context of which primitivism about identity and individuality, rather than being regarded as unscientific, is on the contrary suggested to be preferable to the complicated forms of reductionism that have recently been proposed. More generally, by assuming a plausible form of anti-reductionism about scientific theories and domains, it is claimed that science can be regarded as compatible with, or even as suggesting, the existence of a series of equally plausible grades of individuality. The kind of individuality that prevails in a certain context and at a given level can be ascertained only on the basis of the specific scientific theory at hand. (shrink)

The main claim that I want to defend in this paper is that the there are logical equivalences between eternalism and perdurantism on the one hand and presentism and endurantism on the other. By “logical equivalence” I mean that one position is entailed and entails the other. As a consequence of this equivalence, it becomes important to inquire into the question whether the dispute between endurantists and perdurantists is authentic, given that Savitt (2006) Dolev (2006) and Dorato (2006) have cast (...) doubts on the fact that the debate between presentism and eternalism is about “what there is”. In this respect, I will conclude that also the debate about persistence in time has no ontological consequences, in the sense that there is no real ontological disagreement between the two allegedly opposite positions: as in the case of the presentism/eternalism debate, one can be both a perdurantist and an endurantist, depending on which linguistic framework is preferred. In the first part of the paper I argue that an ontology of events is precise, flexible and general enough so as to cover the three main alternative formulations of quantum mechanics as well as theories advocating an antirealistic view of the wave function. Since these formulations advocate a primitive ontology of entities living in four-dimensional spacetime, they are good candidates to connect that quantum image with the manifest image of the world. However, to the extent that some form of (...) realism about the wave function is also necessary, one needs to endorse also the idea that the wave function refers to some kind of power. In the second part, I discuss some difficulties raised by the recent proposal that in Bohmian mechanics this power is holistically possessed by all the particles in the universe. (shrink)

After some suggestions about how to clarify the confused metaphysical distinctions between dispositional and non-dispositional or categorical properties, I review some of the main interpretations of QM in order to show that – with the relevant exception of Bohm’s minimalist interpretation – quantum ontology is irreducibly dispositional. Such an irreducible character of dispositions must be explained differently in different interpretations, but the reducibility of the contextual properties in the case of Bohmian mechanics is guaranteed by the fact that the positions (...) of particles play the role of the categorical basis, a role that in other interpretations cannot be filled by anything else. In Bohr’s and Everett-type interpretations, dispositionalism is instrumentalism in disguise. (shrink)

An influential position in the philosophy of biology claims that there are no biological laws, since any apparently biological generalization is either too accidental, fact-like or contingent to be named a law, or is simply reducible to physical laws that regulate electrical and chemical interactions taking place between merely physical systems. In the following I will stress a neglected aspect of the debate that emerges directly from the growing importance of mathematical models of biological phenomena. My main aim is to (...) defend, as well as reinforce, the view that there are indeed laws also in biology, and that their difference in stability, contingency or resilience with respect to physical laws is one of degrees, and not of kind . In this paper, we review and connect the three essential conditions needed by the collapse model to achieve a complete and exact formulation, namely the theoretical, the experimental, and the ontological ones. These features correspond to the three parts of the paper. In any empirical science, the first two features are obviously connected but, as is well known, among the different formulations and interpretations of non-relativistic quantum mechanics, only collapse models, as the paper well illustrates with a richness of details, (...) have experimental consequences. Finally, we show that a clarification of the ontological intimations of collapse models is needed for at least three reasons: (1) to respond to the indispensable task of answering the question ’what are collapse models (and in general any physical theory) about?’; (2) to achieve a deeper understanding of their different formulations; (3) to enlarge the panorama of possible readings of a theory, which historically has often played a fundamental heuristic role. In this paper I review three different positions on the wave function, namely: nomological realism, dispositionalism, and configuration space realism by regarding as essential their capacity to account for the world of our experience. I conclude that the first two positions are committed to regard the wave function as an abstract entity. The third position will be shown to be a merely speculative attempt to derive a primitive ontology from a reified mathematical space. Without entering any discussion about nominalism, I (...) conclude that an elimination of abstract entities from one’s ontology commits one to instrumentalism about the wave function, a position that therefore is not as unmotivated as it has seemed to be to many philosophers. By briefly reviewing three well-known scientific revolutions in fundamental physics (the discovery of inertia, of special relativity and of general relativity), I claim that problems that were supposed to be crying for a dynamical explanation in the old paradigm ended up receiving a structural explanation in the new one. This claim is meant to give more substance to Kuhn’s view that revolutions are accompanied by a shift in what needs to be explained, while suggesting at the same time the existence (...) of a pattern that is common to all of the discussed case-studies. Presentists have typically argued that the Block View is incapable of explaining our experience of time. In this paper I argue that the phenomenology of our experience of time is, on the contrary, against presentism. My argument is based on a dilemma: presentists must either assume that the metaphysical present has no temporal extension, or that it is temporally extended. The former horn leads to phenomenological problems. The latter renders presentism metaphysically incoherent, unless one posits a discrete present that, however, (...) suffers from the same difficulties that the instantaneous present is prone to. After introducing the main phenomenological models of our experience of time that are discussed in the literature, I show that none of them favors presentism. I conclude by arguing that if even the phenomenology of time sides against presentism, the latter metaphysical theory has no scientific evidence in its favor and ought to be dropped. (shrink)

The paper compares dispositionalism about laws of nature with primitivism. It argues that while the distinction between these two positions can be drawn in a clear-cut manner in classical mechanics, it is less clear in quantum mechanics, due to quantum non-locality. Nonetheless, the paper points out advantages for dispositionalism in comparison to primitivism also in the area of quantum mechanics, and of contemporary physics in general.

Emotions are a central aspect of communication. Consequently, emotion analysis (EA) is a rapidly growing field in natural language processing (NLP). However, there is no consensus on scope, direction, or methods. In this paper, we conduct a thorough review of 154 relevant NLP publications from the last decade. Based on this review, we address four different questions: (1) How are EA tasks defined in NLP? (2) What are the most prominent emotion frameworks and which emotions are modeled? (3) Is the (...) subjectivity of emotions considered in terms of demographics and cultural factors? and (4) What are the primary NLP applications for EA? We take stock of trends in EA and tasks, emotion frameworks used, existing datasets, methods, and applications. We then discuss four lacunae: (1) the absence of demographic and cultural aspects does not account for the variation in how emotions are perceived, but instead assumes they are universally experienced in the same manner; (2) the poor fit of emotion categories from the two main emotion theories to the task; (3) the lack of standardized EA terminology hinders gap identification, comparison, and future goals; and (4) the absence of interdisciplinary research isolates EA from insights in other fields. Our work will enable more focused research into EA and a more holistic approach to modeling emotions in NLP. (shrink)

This article presents the incidence of the symbol through Latin-American philosophical reflection. It is possible to think of a philosophical activity through the symbol, as a place of a multiplicity of meanings and senses. A new understanding of the symbol lead to re-discover it from the experience of the indigenous Andean communities and Latin American baroque art. The incidence of the symbol in the educational process is performed through an ethical perspective and hermeneutics that focuses on new alternatives for teaching (...) philosophy in the classroom. Wlodek Rabinowicz suggère que deux choses sont à parité si et seulement si il est à la fois permissible de préférer l’une à l’autre et permissible d’avoir la préférence contraire. Dans un article récent, Johan Gustafsson soutient toutefois que l’analyse de Rabinowicz viole un principe de symétrie entre valeurs et préférences, selon lequel il existe pour toute relation de valeur une relation de préférence (...) correspondante (et vice-versa). À la lumière de ce principe, Gustafsson propose une analyse alternative, selon laquelle deux choses sont à parité si et seulement si il est requis d’entretenir ces choses en parité préférentielle. Dans cet article, j’examine en détail les arguments avancés par Gustafsson contre l’analyse de Rabinowicz et je montre qu’aucun d’eux n’est convaincant. (shrink)

In this paper, we propose a defence of Value Realism that relies on the unusual combination of Values Realism with Sentimentalism. What this account, which we call “Sentimental Realism”, holds, in a nutshell, is that what makes evaluative facts special is their relationship to emotions. More precisely, Sentimental Realism claims that evaluative facts are fully objective facts, but that such facts are picked out by concepts that are response-dependent, in the sense that they are essentially tied to emotions. Our plan (...) is as follows. We shall start with a presentation of Sentimental Realism and a discussion of its main virtues. On the basis of this, we shall discuss an objection to Value Realism that draws on evolutionary considerations, the Evolutionary Debunking Argument. There is an intuitive connection between well-being and happiness. Accordingly, many theories of well-being hold that well-being consists in (either unqualified or properly qualified) happiness. Traditional happiness-based theories are subject, however, to several important objections. The goal in this chapter is to offer a new happiness-based theory that is immune to the main objections raised against traditional happiness-based theories. The authors’ own fitting happiness theory of well-being can be seen as the combination of the following claims. The first is that (...) happiness consists in a broadly positive balance of affective states such as emotions, moods, and sensory pleasures. The second is that emotions, moods, and sensory pleasures are different kinds of perceptual experiences of evaluative properties. The third claim is that, insofar as happiness is constituted by states that have fittingness conditions, it is possible to assess happiness itself as fitting or unfitting. This paper is part of a project that is based on the notion of a dialectical system, introduced by Magari as a way of capturing trial and error mathematics. In Amidei et al. (2016, Rev. Symb. Logic, 9, 1–26) and Amidei et al. (2016, Rev. Symb. Logic, 9, 299–324), we investigated the expressive and computational power of dialectical systems, and we compared them to a new class of systems, that of quasi-dialectical systems, that enrich Magari’s systems with a natural mechanism (...) of revision. In the present paper we consider a third class of systems, that of p-dialectical systems, that naturally combine features coming from the two other cases. We prove several results about p-dialectical systems and the sets that they represent. Then we focus on the completions of first-order theories. In doing so, we consider systems with connectives, i.e. systems that encode the rules of classical logic. We show that any consistent system with connectives represents the completion of a given theory. We prove that dialectical and q-dialectical systems coincide with respect to the completions that they can represent. Yet, p-dialectical systems are more powerful; we exhibit a p-dialectical system representing a completion of Peano Arithmetic that is neither dialectical nor q-dialectical. (shrink)

Dentre essas consequências, defende que o reconhecimento do dolo eventual na estrutura finalista do delito acontece de forma incoerente, devido, sobretudo, aos postulados que fizeram do finalismo uma das teorias mais aceitas pela doutrina, a saber: o respeito às estruturas lógico-objetiva e a inclusão do dolo no tipo subjetivo.

In this paper I analyze the difficult question of the truth of mature scientific theories by tackling the problem of the truth of laws. After introducing the main philosophical positions in the field of scientific realism, I discuss and then counter the two main arguments against realism, namely the pessimistic metainduction and the abstract and idealized character of scientific laws. In this paper we argue that the different positions taken by Dyson and Feynman on Feynman diagrams’ representational role depend on different styles of scientific thinking. We begin by criticizing the idea that Feynman Diagrams can be considered to be pictures or depictions of actual physical processes. We then show that the best interpretation of the role they play in quantum field theory and quantum electrodynamics is captured by Hughes' Denotation, Deduction and Interpretation theory of models (DDI), where “models” are (...) to be interpreted as inferential, non-representational devices constructed in given social contexts by the community of physicists. This article values the importance of symbolic language through an Analog Hermeneutics and Communication Community. This philosophical itinerary starts in a collective subject called “Us” (“nosotros”) from the Latin American philosophical reflection. The symbol, such as meaningful space for semantics, shows up in a symbolic language that includes a variety of rationalities. This inclusion through symbolic language allows strengthening the “a priori” of a Communication Community that supports and ethical and historical “us”. For this purpose, an Analog Hermeneutics is presented (...) as a valid method for philosophical thinking around the symbolic language. The analogy allows considering the ambiguous and unambiguous of languages and the hermeneutics through the symbol allows us to speak and think beyond what is stated. The Analog Hermeneutics invites to recover the different meanings and to interpret the senses through the symbol in different cultures. The symbol is a new inspiration for traditional Philosophy because it recovers wisdoms, customs, images and traditions. (shrink)

In this paper I sketch the evolution of the main theories of the relationship between time and motion from Descartes to Newton, by defending an hypothesis that traces back Newton’s realism about time to Barrow’s “metric realism”, which Newton developed as the claim that measuring a magnitude X implies that X exists independently of our measures.

In assessing the efficacy of academic programs, tracer studies serve as indispensable tools, offering insights into graduates' whereabouts and performance in the workforce. This study focuses on tracing the trajectories of Agusan Colleges Incorporated (ACI) graduates from 2014-2015 to 2017-2018, shedding light on the relevance and effectiveness of the institution's degree programs. It determined the demographic profile, employment characteristics of the graduates, evaluated the curriculum’s usefulness of the skills and the relevance of the courses to their professional lives. The study (...) was anchored on Yorke and Knight's employability theory (2004) and applied the Input, Process, Output (IPO) model. A sample size of 146 participants was considered applied with convenient sampling. Descriptive survey method was used and adapted the CHED tracer study questionnaire with other tracer studies of higher educational institutions. Profile variables and employment characteristics were treated with frequency and percent distribution. Relevance and effectiveness were subjected to weighted mean. The study revealed that a majority of participants were young adult females, with almost equal numbers married and single. Currently, 84% are employed, primarily in teaching, government agencies, and business-related roles, with salaries ranging from 10,000 to 34,000 pesos per month, typically with one to six years of service. The findings highlighted the high utility of teaching, communication, entrepreneurial, and human relations skills in participants' workplaces. Core and professional courses were moderately relevant across most programs, while co-curricular courses showed slight relevance, and extracurricular courses were deemed irrelevant to their professional work. Hence, a curriculum evaluation is proposed and also, to future researchers may conduct another tracer study that would include assessment of employers and the live experiences of the employed graduates. El SLOS, causado por mutaciones en (...) el gen DHCR7, presenta variabilidad fenotípica, malformaciones múltiples y discapacidad intelectual. No tiene cura, y la suplementación con colesterol es de eficacia limitada. La revisión destaca la necesidad de diagnóstico prenatal preciso y nuevas intervenciones terapéuticas, como estatinas y antioxidantes, para mejorar la calidad de vida de los pacientes. (shrink)

This article aims to show the emergence of Pre-Socratic Natural Philosophy using the cosmological Big-Bang analogy, where from a certain moment in time and space a universe appears, first in its "inflationary" moment and, soon, in constant expansion. In the case of natural philosophy, it arose with Thales at a certain moment in space and time. It also had its “inflationary” period marked by a large number of philoso-phers and a profound change in the understanding of nature. This period lasted (...) for about 5 generations until philosophy entered its paradigmatic period with Plato and Aristotle. How was the Natural Philosophy Big Bang (NPBB) possible? What were the main factors that made this possible? The text discusses these aspects, and for the author, the main factor must be sought in the internal dynamics of Greek thought and not in external causes, such as the exchange with Babylonians and Egyptians or the economic dynamics. -/- To explain the NPBB, I use the hypothesis of linguistic relativism, meaning that “lan-guage shapes the mind”, in the same line that Bruno Snell used in his 1956 book. That is, the development of the Greek language would be the preponderant factor to explain the dynamics that led to the NPBB. We believe that this hypothesis (currently criti-cized for being excessively deterministic) is justified when applied to the aforemen-tioned situation and can be summarized as follows: “An extraordinary situation re-quires an equally extraordinary explanation”. A set of historical occurrences justifies the application of the strong version of the concept of linguistic relativism, something that today would be difficult to occur. -/- The text synthesizes the main milestones of linguistic relativism, goes through the description of the turn of the oralist society to a society based on writing, which rad-ically changes the way knowledge is stored, in addition to enabling its critical evalua-tion, one of the foundations of philosophy and science. Several authors who are al-ready classics follow a similar line without, however, clearly adopting the author's position. These are the cases of Burnet, Havelock, and Ong. The text also shows some details of the linguistic evolution of Greek and its origins in the oralist mythical tradi-tion. -/- The main conclusion is that linguistic relativism in its strong version is an adequate method to deal with NPBB situation. -/- . The objective of this article is to offer an interpretation of the utopian society described in Plato's Republic from a simplified theory of fractals. Plato conceptualizes his Republic as a static society in terms of structure and its components, the people, as having a behavior that can be programmed as linear and not dynamic (LNDS). Based on this analogy, real social functioning (NLDS) is conceptualized, applying the concept of fractal and its corresponding fracton, as the force of attraction that acts (...) in social groups. Thus, social groups obey a fractal geometry, a geometry that reproduces the pyramidal shape, the apex being the crystallization of authority, power or leadership. Modern society, in analogy with Plato's Republic, is also a fractal production machine, replicating pyramid-shaped hierarchical structures and the respective fractons. Individuals are the basic unit of all these fractals. They are the building blocks of all groups at all levels of society. But replication is not self-similar due to fluctuations in cognition and behavior. (shrink)

This paper analytically responds to the collaborative performance work Writing the Feminist Internet as a motif of fourth wave feminism. It probes at the edge of Internet dark spaces that are often occupied by those who point to complacency in engagement with networking systems, by drawing auxiliary attention to the apparatus. Further examination sheds light on the valences and anarchy of technopolitics that transpired and reflects on the call for ‘hybrid of feminist activist efforts’ noted by Emma A. Jane. Positing (...) towards ‘a recalibrated approach to collectivism’ (2015, 285) Jane continues to give rise to a vast communal realm for the expression of alternative behaviours. In building upon the feminist ‘wave’ metaphor there is acknowledgement that the undercurrents of nautical lineages come to endure through ‘debt, or inheritance’ more often than a confluence of flows. The findings reveal that the potency of a chthonic feminist internet theory lies in its indeterminate stance. In conclusion, it is proposed that ambivalence and prominence in obscurity in such expansive ‘dark social spaces’ is where new meanings and enunciations can brew and be read as a source of critical and aesthetic ambiguity, amongst the highly revered principles of disarray, pandemonium and incompleteness. The text's objective is to show that the Western scientific tradition, since the pre-Socratics, has as one of its traits the search for a unitary and uni-versal system of knowledge. Since the modern age, many attempts have been directed toward the search for the unification of science, culminating in Neurath's analytical philosophy and efforts in cybernetics. These efforts reflected an epistemological expectation for the unity of science, seeking methods and languages that would allow such an achievement. But such an expectation (...) has not yet satisfied the hopes of the monists. The diversifi-cation of science deepened and, at the same time, the problems faced by humanity increased the need for science to offer answers to solve the great global problems. The planet and humanity are under severe pressure in many ways. Pollution and depletion of water resources, threats of mass extinction of biodiversity, deforestation, desertification, global climate change, persistent poverty for large contingents of the world's population, attacks on democratic systems and values in many countries, and, at this moment, a pandemic of great proportions. In short, a threat to the sus-tainability of the planet and civilization as such. The paper goes through Mode 1 of knowledge production, showing that this Model is limited and insufficient to solve the problems humanity is facing. Model 2 of knowledge production is suggested as the immediate perspective to support the cope with humanity´s global problems. This Agenda presupposes a new way to unify science, which transdisciplinarity can bring. Therefore, the unity of science wouldn´t be through reduction-ism or the unification of language, but through the new modus operandi of transdisciplinary practice. (shrink)

The article presents two antagonistic views of reality, one coming from modern science and the other from flat-Earthers, to discuss the relationships between common-sense, science, and reality. The concrete fact under analysis refers to the solar system and the position of the earth in this system, that is, the duality of geocentrism and heliocentrism. After discussing the reasons for denying geocentrism with arguments from theoretical physics, we return to discussing the duality against the backdrop of the history of science, showing (...) that the issue was much more complex when the Ptolemaic paradigm passed to the Copernican one in the 16th century. The article shows that the paradigm shift presupposed the invention of a reality that took more than 100 years to stop being an invention and become a reality. From an epistemological point of view, a discovery, even if it corresponds to empirical facts, needs theoretical support to be considered true or, in the terms we are dealing with here, to be considered reality and part of common sense. Ontologically speaking, we cannot consider a certain worldview as an existing reality beyond the mental model that created it. (shrink)

Kahneman's theory of two systems assumes that human decision making in Economy is based on two cognitive systems, one that is automatic, intuitive and mostly unconscious, and one that is reflexive, rational and fully conscious. The authors consider Kahneman’s approach incomplete and limited in accounting for the creativity of embodied agents grasping the opportunities afforded by physical and social environments. This limitation leads us to argue for the existence of a third system in decision making in Economy, the creative intuition (...) based on direct perception of affordances, addressing not only the dispositions and goals of agents but also the social and environmental responsibility of corporations and governments. The authors argue that the third decision-making system the authors propose implies a concept of intuition that is different from the type of association process discussed by Morewedge and Kahneman [2] and gives an example of the third system operation, the Bolsa Família in Brazil, and finding new options for the funding of similar programs. In this article, we reimagine the Internet as a feminist cosmos called a Feminist Server Stack. By scrutinising how webserver infrastructure is normalised based on imperial conventions and distorted knowledge systems, we suggest alternatives. This embrace of ‘post-patriarchal futures’ (Bardzel 2019, 20) offers counter perspectives on how we may holistically embody the Internet as a situated ecology. When experiencing the Internet materiality, it leads us to imagine beyond the known and possible. We focus on enchanting affirmations and tacit hands-on computational (...) methods from the frontiers of feminist digital literacy and server communities. These acts make visible the seams and fissures of concealed undercurrents and schemata of infrastructures. The findings reveal utterly different relationships between webserver providers and clients. Drawing from extensive fieldwork and observational analysis, we show how the choreography of happenings is seeding the ground for participatively co-designing the transfiguration of planetary computing into one that is scalable, visceral, and restorative. We welcome these nascent pathways to guide us to an enigmatic realm upon which theories of co-design could dance in communion with a realm that is to-come. (shrink)

A teoria dos dois sistemas (Kahneman, 2011), em suas várias vertentes, assume que a tomada de decisão humana é baseada em dois sistemas cognitivos: um que é automático, rápido, agindo com mínimo esforço cognitivo, intuitivo (no sentido de Morewedge & Kahneman, 2010), e majoritariamente inconsciente; e outro que é reflexivo, lento, atuando com intenso esforço cognitivo, racional e totalmente consciente. Neste trabalho, investigamos a teoria dos dois sistemas e sua aplicação na tomada de decisão econômica em governos democráticos, com ênfase (...) especial na proposta de Kahneman. Consideramos sua abordagem incompleta e limitada na explicação do processo intuitivo que orienta a tomada de decisão. Essa limitação nos leva a defender a existência de um terceiro sistema de tomada de decisão em Economia: a intuição ecológica criativa, baseada no attunement entre affective drives e percepção direta de affordances, abordando não só as disposições e objetivos dos agentes, mas também a responsabilidade socioambiental das empresas e governos. Argumentamos que o terceiro sistema de tomada de decisão que propomos implica um conceito de intuição diferente do associativismo de ideias de Simon (1992), e damos como exemplo do funcionamento do terceiro sistema o processo de tomada de decisão que conduziu à formação do Banco Finapop, no Brasil. In this paper I examine the role of dispositional properties in the most frequently discussed interpretations of non-relativistic quantum mechanics. After offering some motivation for this project, I briefly characterize the distinction between non-dispositional and dispositional properties in the context of quantum mechanics by suggesting a necessary condition for dispositionality – namely contextuality – and, consequently, a sufficient condition for non-dispositionality, namely non-contextuality. Having made sure that the distinction is conceptually sound, I then analyze the plausibility of the widespread, monistic (...) ontological thesis about the reducibility of dispositional properties to categorical properties in the context of the philosophy of quantum mechanics. I conclude that with the exception of Bohmian mechanics, the other “minimally realist” views of quantum mechanics require essential dispositions, i.e., dispositions of a non-reducible kind. Interestingly, seen behind the lenses of dispositionalism, Bohr’s and Bohm’s interpretations of quantum mechanics are much closer than it is usually recognized, a fact that could teach us something about the way the quantum world is. The paper is about 'absolute logic': an approach to logic that differs from the standard first-order logic and other known approaches. It should be a new approach the author has created proposing to obtain a general and unifying approach to logic and a faithful model of human mathematical deductive process. In first-order logic there exist two different concepts of term and formula, in place of these two concepts in our approach we have just one notion of expression. In our system (...) the set-builder notation is an expression-building pattern. In our system we can easily express second-order, third order and any-order conditions. The meaning of a sentence will depend solely on the meaning of the symbols it contains, it will not depend on external 'structures'. Our deductive system is based on a very simple definition of proof and provides a good model of human mathematical deductive process. The soundness and consistency of the system are proved. We discuss on the completeness of our deductive systems. We also discuss how our system relates to the most know types of paradoxes, from the discussion no specific vulnerability to paradoxes comes out. The paper provides both the theoretical material and a fully documented example of deduction. (shrink)

No capítulo 1, “Do escudo de Aquiles à capa do Batman: o heroísmo togado e seus riscos à democracia”, discutimos a ascensão do protagonismo político no Poder Judiciário a partir da categoria antropológica do herói, expondo a delicada relação entre heroísmo e instituições democráticas. Para isso, traçamos um breve histórico do heroísmo e suas características, apresentando, posteriormente, uma analogia entre elas e a atuação do Ministro Joaquim Barbosa no curso da Ação Penal nº 470 do STF (Caso Mensalão). Tecemos também (...) alguns apontamentos sobre o Estado Democrático de Direito, a função do Poder Judiciário e os riscos que a propagação de escândalos públicos e a flexibilização de regras e princípios jurídicos podem trazer às instituições do Estado Democrático de Direito. O tema de fundo dessa análise é a relação simbiótica entre a violência e a produção mítica de heróis, segundo a teoria de Girard. No capítulo 2, “Satã: a violência na fundação da cultura”, analisamos a obra “Vejo Satã cair como um relâmpago”, de René Girard, apresentando sua teoria (mimética) e seu estudo antropológico da Bíblia e dos Evangelhos. O intuito é demonstrar a possibilidade de interpretar racionalmente dados antes percebidos como sobrenaturais, explorando, com Girard, as contribuições da revelação judaico-cristãs para a relação entre o homem, a violência e a organização político-religiosa do mundo antigo. O principal tema exposto na resenha é o da violência fundadora, base da cultura e da sociedade, que Girard identifica na figura bíblica de Satã. Mais do que mero símbolo religioso, Satã é a representação de um mecanismo de pacificação deflagrado em situações de crise social. Seu modus operandi consiste na reunião da sociedade contra um inimigo comum, um bode expiatório contra o qual levantam-se falsas acusações que sustentam sua perseguição e assassinato. Consideramos esse tema fundamental para a moderna e contemporânea compreensão dos processos de perseguição e vitimização político-social. A revelação cristã é a entrada em cena, no campo histórico, de um pensamento que se coloca francamente ao lado da vítima acusada pela comunidade. As ideologias penais da proteção do débil, os direitos individuais e os direitos humanos são efeitos políticos e jurídico do triunfo da cruz sobre a cultura satânica do assassínio de bodes expiatórios. No capítulo 3, “A violência no Direito: confissão e produção de bodes expiatórios”, aplicamos a teoria mimética para compreender o instituto jurídico da confissão do ponto de vista antropológico. Com base no Livro de Jó, investigamos a origem religiosa da extração forçada de confissões e demonstramos sua íntima relação com os rituais religiosos praticados na antiguidade, que usavam da assunção de culpa como um instrumento para legitimar a violência contra seus bodes expiatórios. Com isso, pretendemos apontar para a necessidade de mitigação do valor probatório da assunção de culpa no contexto de um Estado Democrático de Direito. Incorporada às intuições jurídicas, a confissão deve ser tomada como instrumento laico e totalmente desvinculado das práticas expiatórias que lhe deram origem. No capítulo 4, “Direito penal e preocupação pelas vítimas: a renovação dos princípios de ofensividade e proteção de bens jurídicos após a experiência do totalitarismo", analisamos o surgimento e desenvolvimento da ideia de crime como ofensa a bens jurídicos. Trata-se de um ensaio de história das ideias jurídicas em que traçamos a evolução histórica das ideias de ofensividade e proteção de bens jurídicos, desde sua gênese na experiência liberal e iluminista, passando por seu enfraquecimento durante o Direito Penal nacional-socialista, até culminar em seu ressurgimento e renovação nos dias atuais. O intuito desta análise é situar o princípio da ofensividade, enquanto garantia assegurada nas Constituições do Pós-guerra, no quadro histórico da moderna preocupação pelas vítimas, efeito cultural da religião cristã que discutimos no capítulo 2 (“Satã: a violência na fundação da cultura”). Por fim, no quinto e último capítulo, “O Direito após a revelação do mecanismo vitimário”, procuramos rematar a temática do Direito no quadro da antropologia de Girard, explorando o papel desempenhado pela revelação cristã do mecanismo expiatório na cultura ocidental, especialmente no que diz respeito à formação de uma ética de proteção das vítimas, eixo fundamental dos Direitos Humanos. Por isso, demonstramos como o Direito Penal, no ocidente, está dividido entre o sacrifício e o perdão. Resultado da lógica do cristianismo sacrificial, o moderno Direito constitui-se na forma híbrida de um Katéchon: ou seja, como racionalização do mecanismo vitimário, re-direcionado, por meio das instituições jurídicas e políticas, contra atos de perseguição de minorias e vulneráveis . Esta investigação tem por objetivo geral promover uma exposição do estado da arte do conceito de dolo eventual na dogmática penal, e, como objetivo específico, estabelecer bases metodológicas de como esse conceito pode ser construído, sistematizado e delimitado em relação à culpa consciente. A delimitação dos conceitos jurídico-penais é um importante instrumento para o estabelecimento de limites ao exercício do poder punitivo estatal. O conceito de dolo, na medida em que autoriza a aplicação de penas mais rigorosas em comparação à (...) culpa, demanda que a dogmática estabeleça claramente seus limites. Tarefa necessária não apenas para o conceito geral de dolo, mas também para o controverso “dolo eventual”, figura jurídica cuja conceituação e aplicação tem propiciado intensos debates na doutrina especializada, que, há pelo menos 200 anos, discute o problema de sua distinção com relação à outra figura não menos debatida, a da culpa (consciente). Devido à dificuldade de sua resolução, o pai do finalismo, Hans Welzel, considerou a distinção entre dolo eventual e culpa consciente uma das questões mais tormentosas do direito penal. Visando contribuir para o esclarecimento do tema, esta investigação apresenta dialeticamente os principais critérios e argumentos formulados na resolução desse intrincado problema jurídico, abrangendo, para este fim, tanto a discussão do período clássico da dogmática alemã (que legou vários conceitos até hoje debatidos e usados nesta matéria) quanto da moderna dogmática jurídico-penal, que tenta, a partir de novas abordagens, resolver a “tormentosa” questão.
